1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the SmarterToday platform available at joinsmartertoday.com (the “Platform”), operated by SmarterToday (“we,” “our,” or “us”). By registering for or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf before you may use the Platform.
2. The Platform
SmarterToday is an online marketplace that connects Students with Tutors, mentors, and coaches offering instruction across a wide range of subjects including but not limited to languages, business skills, hobbies, and life skills. All sessions are conducted through the Platform.
We do not employ Tutors. Tutors are independent service providers, and SmarterToday acts solely as a marketplace facilitating connections between Students and Tutors.
3. Eligibility
To use the Platform you must:
- Be at least 18 years of age, OR be a minor with verified parental or guardian consent
- Provide accurate and complete registration information
- Agree to these Terms and our Privacy Policy
- Not be prohibited from using the Platform under applicable law
We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@joinsmartertoday.com of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.
5. Tutor Responsibilities
Tutors who register on the Platform agree to:
- Provide accurate information about their qualifications, experience, and areas of expertise
- Conduct sessions professionally and as described in their profile
- Comply with all applicable laws, including those related to working with minors where applicable
- Not engage in any conduct that is harmful, abusive, discriminatory, or illegal
- Maintain appropriate background checks or certifications where required by law
- Not solicit Students to conduct sessions outside the Platform to circumvent our payment system
6. Student Responsibilities
Students who use the Platform agree to:
- Treat Tutors respectfully and professionally
- Attend booked sessions or cancel within the permitted cancellation window
- Not record sessions without the explicit consent of the Tutor
- Not share Platform content or session materials without authorization
- Not attempt to contact or transact with Tutors outside the Platform
7. Payments
7.1 Payment Processing
All payments are processed through the Platform. Students pay for sessions through our secure payment system. SmarterToday collects payment on behalf of Tutors and remits amounts to Tutors after deducting applicable platform fees.
7.2 Fees
SmarterToday charges a platform service fee on each transaction. Current fee structures are displayed on the Platform and may be updated from time to time with notice.
7.3 Refunds and Cancellations
- Cancellations made at least 24 hours before a scheduled session are eligible for a full refund
- Cancellations made less than 24 hours before a session may be subject to a cancellation fee
- In the event of a Tutor cancellation, Students will receive a full refund
- Disputes regarding session quality or conduct must be submitted to support@joinsmartertoday.com within 48 hours of the session
8. Minors
When a minor uses the Platform, the parent or guardian who provided consent:
- Takes full responsibility for the minor’s use of the Platform
- Agrees to supervise the minor’s sessions as they deem appropriate
- Acknowledges that SmarterToday is not responsible for the content of sessions beyond what is described in a Tutor’s profile
Tutors working with minors are expected to conduct sessions appropriately and professionally at all times. Any inappropriate conduct involving a minor must be reported immediately to support@joinsmartertoday.com.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Platform or other users’ accounts
- Use automated tools to scrape or access the Platform
- Reproduce, distribute, or exploit Platform content without authorization
- Engage in any conduct that could damage, disable, or impair the Platform
10. Intellectual Property
All content on the Platform including text, graphics, logos, and software is the property of SmarterToday or its licensors and is protected by Canadian and international intellectual property laws. You may not use, copy, or distribute Platform content without our prior written permission.
11. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not endorse, verify, or guarantee the qualifications, skills, or representations of any Tutor.
12. Limitation of Liability
To the maximum extent permitted by applicable law, SmarterToday shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to damages for loss of profits, data, or goodwill.
Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount paid by you to SmarterToday in the three (3) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless SmarterToday and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.
14. Dispute Resolution
In the event of a dispute between a Student and a Tutor, we encourage both parties to first attempt resolution directly. If unresolved, you may contact us at support@joinsmartertoday.com and we will make reasonable efforts to assist in mediation. SmarterToday’s decision in any Platform-related dispute is final with respect to access and use of the Platform.
15. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases immediately.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the effective date. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
